Terms and Conditions
This is a translation for convenience. Only the German version is legally binding.
1. Scope
These terms and conditions apply to all services provided by Anne Draskowitsch, art therapist, [Street Address], [Postal Code] [City], Germany ("I"), in particular art therapy sessions for adults and children – in person, via Zoom or via messenger – as well as seminars and events. Deviating terms only apply if I expressly agree to them in writing.
2. Nature of the service
Art therapy is a supportive, creative-therapeutic accompaniment. It is not medical treatment within the meaning of the German Heilpraktikergesetz and does not replace medical, psychiatric or psychotherapeutic diagnosis or treatment. Please do not stop any ongoing treatment or medication without consulting your doctor. [Adjust if a Heilpraktiker licence is held.]
I provide careful accompaniment to the best of my knowledge, but do not owe any particular result. Taking part requires normal mental and physical resilience. Please let me know in advance about known illnesses or ongoing treatment.
3. Conclusion of contract
A contract is concluded when we arrange a session or seminar place by email, messenger, phone or in person and I confirm it. For children and young people under 18, the legal guardians conclude the contract and thereby consent to the sessions.
4. Fees and payment
The fee stated when arranging the appointment applies. [Currently: individual session (60 minutes) … €; children (45 minutes) … €; seminars as advertised.] [All prices are final prices; no VAT is charged in accordance with § 19 UStG. – or: including statutory VAT.]
The fee is payable [after each session in cash or by bank transfer / within 14 days of invoicing]. Seminar fees are due before the seminar begins. Statutory health insurers generally do not cover the costs; please check any reimbursement from private or supplementary insurance yourself.
5. Cancellation of sessions
You can cancel or reschedule a session free of charge up to [48] hours in advance. For later cancellations or no-shows I charge [50% / the full] fee, unless you are not responsible for the cancellation or I can fill the slot. You remain entitled to prove that I incurred no or less loss.
If I have to cancel a session, I will offer a new appointment as soon as possible. No further claims arise from this.
6. Seminars and events
Registration is binding once I confirm it. If you withdraw up to [14] days before the start, I refund the full fee; up to [7] days before, [50]%; after that, no refund is possible. You may name a substitute at any time. If a seminar is cancelled due to too few participants, illness or force majeure, I refund any fees already paid in full.
7. Online sessions
For sessions via Zoom or messenger, please ensure a stable internet connection and an undisturbed space. If the connection drops for technical reasons outside my control, the time will not be made up. Sessions are not recorded by either party. Information on data protection can be found in the privacy policy.
8. Confidentiality
I treat everything you share with me in our sessions confidentially, including after our work together has ended. Exceptions apply where there is a legal duty of disclosure or an acute danger to life and limb must be averted. For children, I agree with the legal guardians which content will be shared.
Pictures and works created in the sessions belong to you.
9. Liability
I am liable without limitation for intent and gross negligence and for injury to life, body and health. For slight negligence, I am only liable for breach of essential contractual obligations, limited to foreseeable, typical damage. I accept no liability for items brought along or for damage to clothing from art materials.
You remain responsible for yourself during and outside the sessions. For children, the legal guardians are responsible for supervision outside the session.
10. Right of withdrawal for consumers
If you conclude the contract exclusively by email, phone or messenger, you have a statutory right of withdrawal as a consumer.
Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform me (Anne Draskowitsch, [Street Address], [Postal Code] [City], phone +49 176 204 747 02, email olla@annedraskowitsch.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. by email or letter). To meet the withdrawal deadline, it is sufficient for you to send your notice before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, I will reimburse all payments received from you without undue delay and no later than fourteen days from the day I receive your notice of withdrawal, using the same means of payment you used for the original transaction unless expressly agreed otherwise. If you requested that the service begin during the withdrawal period, you shall pay me an amount proportionate to what has been provided until you informed me of your withdrawal.
The right of withdrawal expires once I have fully provided the service, if you expressly agreed beforehand that I begin before the end of the withdrawal period and acknowledged that you lose your right of withdrawal once the contract has been fully performed. Under § 312g(2) no. 9 BGB there is no right of withdrawal for seminars on a fixed date.
Model withdrawal form
If you wish to withdraw from the contract, please complete and return this form: To Anne Draskowitsch, [Street Address], [Postal Code] [City], olla@annedraskowitsch.de – I/We hereby give notice that I/we withdraw from my/our contract for the provision of the following service: … / Ordered on: … / Name: … / Address: … / Signature (only if this form is notified on paper) / Date.
11. Final provisions
German law applies. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer protection provisions of their country of residence. Should any provision be invalid, the validity of the remaining provisions is unaffected.
